Terms and conditions

These terms apply to the use of cmsweb.nl, a service of Streamtoppers.nl. By taking out a subscription you agree to these terms. In case of differences between translations, the Dutch version prevails.

1. The service

cmsweb.nl provides a hosted website for internet radio, with an admin area, a DJ panel and the features included in your subscription. We take care of hosting, updates, security and backups of the software. You are responsible for your own stream, your streaming panel and the content of your site.

2. Subscription and term

• You choose a term of one month, three months or one year. The term starts on the start date we agree on together.
• Before the end of the term you get a notice in your admin area. You renew by paying the new invoice.
• If you do not renew, your site stays online for a short period after the end date. After that it goes offline. We keep your data for a while, so you can continue right away if you renew.
• Extensions (plugins) can be added for a monthly fee and run along with your subscription.

3. Prices and payment

Prices and the term are stated in your order or quotation. You receive an invoice by email, which you pay within the term stated on the invoice. If you do not pay on time, we may take your site offline temporarily after a reminder.

4. Cancellation

Your subscription ends at the end of the paid period if you do not renew. There is no automatic renewal. If you want to stop earlier, a refund of a paid period is not possible unless we agree otherwise.

5. Your content and use

• You are responsible for everything you publish and broadcast on your site, and for the necessary rights, including music rights.
• You do not use the service for illegal content, spam or anything that harms others. If that happens anyway, we may take your site offline (temporarily).
• You keep your login details and licence code secret.

6. Availability and maintenance

We do our best to keep your site available at all times, but cannot guarantee uninterrupted availability. We carry out planned maintenance at quiet times as much as possible. Problems with your stream or streaming panel from another provider fall outside our service.

7. Your data

Your data remains yours. You can download a backup in your admin area at any time. How we handle personal data is described in our privacy policy.

8. Liability

Our liability is limited to direct damage and to a maximum of the amount you paid for the service in the last three months. We are not liable for indirect damage, such as lost income, or for damage caused by content you publish yourself.

9. Changes

We may improve the service and change these terms. We will announce important changes in good time. The date at the top shows when the terms were last changed.

10. Applicable law

These terms are governed by Dutch law. If we cannot resolve a dispute together, either party may submit it to the competent court in the Netherlands.
